Netherstowe House Booking Terms & Conditions

Once you have booked your stay, our agreement is a legal contract and any deposit you have paid is non-refundable. If you need to cancel please contact us immediately. For cancellations made up to 7 days before your booking you will not be liable for the total balance. For cancellations made after this time or by failing to take up the booking without cancelling you will be liable for the total amount.

1 Agreement

This Agreement is made between Lont Properties Limited whose Registered Office is at The Lont, Crawley Lane, Kings Bromley, Burton upon Trent, Staffordshire, DE13 7JF and the Applicant

1.1 Definitions and interpretation

For all purposes in this agreement the terms defined in this clause shall have the meanings specified

2 “The Company”

The Company means Lont Properties Limited

2.1 “The Furniture and Furnishings”

“The Furniture and Furnishings” means the furniture and furnishings used by the Applicant from time to time in the Apartment, and provided by Lont Properties Limited

2.2 “The House”

“The House” means the owner’s property known as Netherstowe House, Netherstowe Lane, Lichfield, Staffordshire WS13 6AY

2.3 “The Room”

“The Room” means the rooms in the House that are from time to time allotted to the Applicant by the Company and which room initially is the room described on the Applicants booking confirmation.

3. Nature of this agreement

This agreement is not intended to confer exclusive possession on the Applicant nor to create the relationship of landlord and tenant between the parties. The Applicant shall not be entitled to a tenancy, or to an assured shorthold or assured tenancy, or to any statutory protection under the Housing Act 1988 or to any other statutory security of tenure now or upon the determination of the Licence

4 Licence to occupy

The Company permits the Applicant to occupy the Room or share the occupation of the Room with such person or persons the Company may approve occupation being by the Applicant personally and such person or persons only, and to use the Furniture and Furnishings upon the terms set out in this booking form

5 Keys

5.1 The Company will issue to the Applicant one key to the Room and the House

5.2 If the Applicant loses a key then the Applicant shall pay to the Company £10 for each replacement key provided by the Company

5.3 The Company shall retain its own key to the Room and it and any persons authorised by it, including other grantees of the use of the Room, may exercise the right to use the key and obtain free entry to the Room at any time

6 Access and use of facilities

The Applicant shall have the right to use the front door, entrance hall, staircase, and the landings of the House and to use the gymnasium in the basement of Netherstowe House Mews in a reasonable manner and at the Applicant’s own risk for exercise in common with the Company and the other licensees of the Company

7. Furniture and Furnishings

7.1 The Applicant must keep the Furniture and Furnishings in good order and condition and must not remove any of them from the Room. The Applicant must make good any damage to the Furniture and Furnishings caused by the Applicant or the Applicant’s invitees and replace with articles of a similar kind and value any items broken or damaged by him or them, as reasonably requested by the Company

7.2 The Company confirms that the Furniture and Furnishings comply with the Furniture and Furnishings (Fire Safety) Regulations 1988 as amended

8. Rubbish

The Applicant must ensure that all rubbish is disposed of daily and placed in the rubbish bin provided by the Company

9. Services

9.1 The Company must provide the services for the Applicant in respect of the Room set out in netherstowehouse.com

9.2 The Company confirms that it has complied with the Gas Safety (Installation and Use) Regulations 1998 and the safety certificate is available for inspection by the Applicant

10. Determination

The Agreement may be determined:

10.1 by the Company giving to the Applicant not less than twenty four hours (24hours) notice period

10.2 in respect of the occupation of any particular Apartment in the House, by the Company giving written notice directing the Applicant to use another room or apartment at Netherstowe House Mews instead subject to the Applicant having 24 hours to remove his personal effects to the substituted room or apartment

10.3. by the Company forthwith if the Applicant is in breach of any condition of this agreement but without prejudice to any other remedies of the Company in respect of the breach

11 Vacation of the Apartment

Upon determination of the Agreement, the Applicant shall immediately cease to be entitled to use the Room and the House and must vacate the Room, leaving it clean and tidy, and return the key to the Company immediately

12 Liability

The Company do not accept any liability for any damage, loss or injury to the Applicant or any vehicles or possessions

13 Data

Any data gathered during the course of the Applicants booking may be held on computer by the Company

14 Acknowledgements

14.1 This agreement embodies the entire understanding of the parties relating to the Apartment and the House and to all the matters dealt with by any of the provisions of this agreement

14.2 In particular and without prejudice to the generality of the foregoing the Applicant acknowledges that he has received a copy of this agreement and has had the opportunity of taking legal advice on it and has read and understood it, and acknowledges that the Room and all parts of the House will be shared with the Company and other persons to whom the Company grants a licence and that he will not have exclusive possession of the Room or any part of the House under any circumstances
